Elon Musk spent more than seven hours testifying over three days in a California court, accusing OpenAI of abandoning the nonprofit mission on which it was founded. Musk argued that the organisation was originally created to develop artificial intelligence for the benefit of humanity rather than private commercial gain.
The legal battle, being heard in Oakland, centres on Musk’s claim that OpenAI leaders shifted the company away from its founding principles. He has also sued Sam Altman and Greg Brockman, alleging they broke commitments made during the early formation of the company.
During testimony, Musk repeatedly described OpenAI as a "charity", saying donors and supporters backed the venture, believing it would remain non-profit. He claimed the later push toward commercial expansion contradicted that promise. Musk said the public trusted the company to act as a responsible steward of powerful AI systems.

OpenAI has strongly rejected Musk’s allegations and maintains that its structure evolved to secure the enormous funding required to compete in advanced AI research. The company says building cutting-edge models demands billions of dollars in computing power, talent and infrastructure that a traditional nonprofit model could not sustain.
The case has become one of the most closely watched disputes in the tech world, as it raises larger questions over who should control advanced artificial intelligence. It also highlights the growing rivalry between Musk and OpenAI, especially after Musk launched his own AI company, xAI, to compete in the same space.
