An Allahabad High Court judge has recused himself from hearing a case involving allegations of dual citizenship against Congress leader Rahul Gandhi. The development comes amid ongoing legal proceedings linked to claims that Gandhi holds citizenship of both India and the United Kingdom, which would violate Indian law.
Justice Subhash Vidyarthi stepped aside from the matter on Monday, citing concerns over the petitioner’s conduct and remarks made on social media. The case had sought the registration of a First Information Report (FIR) against Gandhi under multiple legal provisions.
According to reports, the petitioner had approached the court seeking action under laws including the Bharatiya Nyaya Sanhita, the Official Secrets Act, the Foreigners Act, and the Passport Act. The allegations centre around claims that Gandhi may have held dual citizenship, an issue that has been raised in legal and political circles in the past as well.

In his recusal statement, Justice Vidyarthi noted that comments made by the petitioner on social media indicated a lack of trust in the court. He observed that the petitioner had cast aspersions on the judicial process, particularly in relation to a previous order that had delayed the filing of an FIR.
The judge further stated that the petitioner had failed to acknowledge errors in presenting facts before the court and instead attributed delays to the court’s functioning. In light of these circumstances, he concluded that it would not be appropriate for him to continue hearing the matter.
With the judge recusing himself, the case is expected to be reassigned to another bench of the Allahabad High Court for further proceedings. The development highlights the importance of maintaining decorum and trust in judicial processes during ongoing legal disputes.
