BJP MP Nishikant Dubey announced on Saturday that he has filed a privilege case under Article 105 of the Constitution against Jharkhand's Chief Secretary, Director General of Police, Deoghar Deputy Commissioner, and Superintendent of Police. The move comes in response to an FIR lodged against him and BJP MP Manoj Tiwari for allegedly "forcibly" entering the sanctum sanctorum of the Baba Baidyanath Temple in Deoghar on August 2, an act claimed to have hurt religious sentiments.
Speaking to reporters in Deoghar, Dubey defended his actions, asserting his role as a trustee of the Baba Baidyanath Dham Temple as per legal provisions. "As an MP, I am a step ahead of the priest. On what basis was the FIR filed against me?" he questioned. Dubey revealed he visited the Baba Mandir police station to court arrest, but the police refused to detain him.
In a post on X, Dubey stated, "Fifty-one cases have been lodged against me. I have filed a privilege case under Article 105 against the chief secretary, DGP, Deoghar DC, and SP of Jharkhand." The privilege motion invokes parliamentary protections under Article 105, which safeguards MPs' rights to perform their duties without undue interference.

The FIR stems from an incident where Dubey and others allegedly breached temple protocols, sparking controversy. Dubey's counteraction escalates the tension between the BJP and Jharkhand authorities, highlighting a clash over legal privileges and religious sensitivities. The case could set a significant precedent for parliamentary immunity in India, as Dubey vows to challenge what he calls baseless accusations.
