The NBA has officially approved one of the most significant draft system overhauls in recent league history, introducing bold new anti-tanking rules that will take effect with the 2027 NBA Draft. The NBA Board of Governors passed the reforms, which expand the draft lottery from 14 to 16 teams and fundamentally reshape how franchises can rebuild through the draft.
The new system, dubbed the “3-2-1 Lottery,” flattens the odds for winning the No. 1 overall pick and introduces a relegation-style penalty zone for the league’s worst-performing teams. Under the updated rules, teams that miss the playoffs or Play-In Tournament but finish in the fourth through 10th-worst records will receive three lottery balls each, giving them an 8% chance at the top pick. Meanwhile, the bottom three teams will be “draft relegated” and receive only two lottery balls, reducing their odds to 5.4% — worse than several mid-tier non-playoff teams.
Perhaps the most dramatic change is that the bottom three teams will have a floor at the No. 12 pick, meaning they cannot fall lower than that, while other lottery teams can drop as far as No. 16. This completely inverts the traditional incentive structure, where intentionally losing guaranteed better draft positioning. The No. 9 and No. 10 Play-In seeds in each conference will receive two lottery balls each (5.4% chance), while the losers of the No. 7 vs. No. 8 Play-In games will receive one ball each (2.7% chance).

Additional anti-tanking measures include a ban on any team winning the No. 1 pick in back-to-back years and a prohibition on securing three consecutive top-five picks. Teams will also no longer be able to protect first-round picks in the No. 12 to No. 15 slots in most trade scenarios. Commissioner Adam Silver has been granted stronger enforcement powers, including the ability to fine teams up to $10 million, force draft pick forfeitures, transfer picks, or alter draft positions for blatant tanking violations.
The 3-2-1 Lottery will be in effect for the 2027, 2028, and 2029 NBA Drafts, giving the league a three-year window to evaluate whether the reforms successfully discourage intentional losing. The proposal was reviewed by the NBA’s competition committee over several months, with Commissioner Silver previously stating that minimizing the upside of tanking was a top priority for preserving competitive integrity.
This reform marks a pivotal shift in how NBA franchises may approach rebuilding, as intentionally losing games no longer guarantees a top draft pick and could actually penalize a team’s odds. The changes reflect the league’s broader effort to maintain fan interest, ensure competitive balance, and uphold the integrity of competitive play across all 30 franchises.
