Sonam Wangchuk’s wife Gitanjali Angmo has approached the Delhi High Court again seeking permission to transfer the activist from Safdarjung Hospital to a private medical facility. The petition will be mentioned before a division bench of Chief Justice DK Upadhyaya and Justice Tejas Karia on Monday at 10:30 am for urgent listing. The fresh plea challenges an earlier order passed by a single judge of the Delhi High Court, which declined to immediately allow Wangchuk’s transfer from Safdarjung Hospital.

The court had observed that the government’s decision to admit Wangchuk to the hospital was taken considering his medical condition and could not be described as arbitrary. Justice Mini Pushkarna, who heard the matter during a special sitting on Sunday, refused to grant immediate relief to Gitanjali Angmo. The court’s order came after Wangchuk was shifted to Safdarjung Hospital following concerns over his health during his prolonged hunger strike.

In her petition before the division bench, Gitanjali has argued that the earlier order did not adequately address the issue of informed consent in medical treatment. She has contended that an individual’s right to medical care also includes the autonomy to accept, reject or partially refuse medical interventions. The petition further argues that Wangchuk’s continued stay at Safdarjung Hospital amounts to an unlawful restriction on his personal liberty.

Gitanjali has claimed that the activist is effectively being confined within the hospital premises despite there being no formal arrest or detention order against him. The legal challenge comes amid Wangchuk’s ongoing hunger strike, during which he has demanded accountability over issues related to the education sector, including alleged examination irregularities. He has said that he will end his fast only if certain conditions are fulfilled, including assurances from the government or political leaders on addressing the concerns he has raised.

Earlier, Wangchuk had been removed from the protest site and taken to Safdarjung Hospital after concerns emerged over his health following an extended period of fasting. His supporters have continued to raise questions about his treatment and have sought clarity over his medical decisions. The Delhi High Court’s division bench will now consider whether the matter requires urgent intervention and whether the earlier order should be reviewed. The court’s proceedings are expected to focus on issues related to medical consent, personal liberty and the circumstances surrounding Wangchuk’s hospitalisation.

The case has attracted attention due to Wangchuk’s public profile and the wider debate surrounding his protest. While authorities have maintained that his hospital admission was based on medical concerns, his wife’s petition argues that his personal choice regarding treatment and location of care must also be considered. Further developments are expected after the hearing, as the court decides whether to entertain the plea and examine the request for Wangchuk’s transfer from Safdarjung Hospital.
