The Allahabad High Court has recommended action against a Ghaziabad civil court judge for a controversial property dispute ruling, terming it “deliberate judicial misconduct” and a “daylight judicial murder". The bench raised serious concerns about the integrity of the lower court’s judgement, which had granted both possession and ownership of a property to a tenant.
The dispute involved a tenant who, according to the civil court’s ruling, was erroneously declared the rightful owner of the property. The High Court set aside the Ghaziabad civil court’s order, emphasising that the judgement displayed a clear violation of legal principles and judicial ethics.
“The decision of the lower court appears to be a deliberate act, undermining the rule of law and harming the legitimate property rights of the owner,” the bench noted. It called the ruling an extraordinary instance of judicial overreach, describing it as a “daylight judicial murder” of proper legal procedure.

The Allahabad HC’s recommendation for disciplinary action highlights the judiciary’s internal mechanisms for addressing misconduct and ensuring accountability. Such recommendations are rare and underscore the severity with which higher courts view breaches of judicial responsibility.
The High Court did not specify the exact nature of the action to be taken against the civil judge but indicated that the matter would be forwarded to the appropriate judicial authorities for further proceedings. Legal experts suggest that this could include a departmental inquiry or other corrective measures.
