A court in the US state of Utah has postponed a decision on whether there is sufficient evidence to move forward with a murder trial in the killing of right-wing influencer Charlie Kirk. At the conclusion of a week-long preliminary hearing on Friday, the presiding judge said proceedings would resume in September before determining whether the case against the accused should proceed to trial.
The case involves 23-year-old Tyler Robinson, who is charged with the fatal shooting of Kirk and faces the possibility of the death penalty if convicted. Prosecutors allege that Robinson shot Kirk in the neck on September 10 while the conservative activist was addressing a gathering on a college campus. The event had been organised by Turning Point, the right-wing youth organisation founded by Kirk, which has been closely associated with campaigns supporting US President Donald Trump.
During the preliminary hearing, prosecutors presented a range of evidence that they argued linked Robinson to the killing. This included video game chat records and text messages that, according to the prosecution, demonstrated Robinson's alleged motive. Prosecutors told the court the communications suggested the accused was "fed up" with what he viewed as the "hate" spread by Kirk, and argued that the messages supported their claim that the shooting was intentional.

The defence, however, challenged key aspects of the prosecution's case. Robinson's lawyers questioned the reliability of the DNA analysis that investigators say connects him to the crime scene, raising concerns about the forensic evidence presented during the hearing. The defence has also not disclosed how Robinson intends to plead if the case proceeds to trial, leaving that question unresolved as legal proceedings continue.
A preliminary hearing in the US legal system is intended to determine whether prosecutors have presented enough evidence to establish probable cause that a crime was committed and that the accused may have committed it. It is not a trial and does not determine guilt or innocence. If the judge concludes that the prosecution has met the required legal threshold when the hearing resumes in September, the case will proceed to a full trial where evidence will be examined in greater detail before a jury.
The postponement means the high-profile case will remain under judicial review for several more weeks as both sides prepare additional legal arguments. Charlie Kirk was a prominent conservative commentator and the founder of Turning Point, an organisation known for its activism on US college campuses and support for conservative political causes. The outcome of the preliminary hearing will determine whether Robinson ultimately stands trial on murder charges in a case that has drawn significant public and political attention across the United States.
