CBI Open To Probe Alleged Corruption Linked To Punjab Chief Minister’s Office

The Central Bureau of Investigation (CBI) has informed the Punjab and Haryana High Court that it has no objection to taking over an investigation into allegations of corruption, illegal gratification and quid pro quo arrangements in Punjab, if the court decides to entrust the probe to the central agency. The development comes during the hearing of a public interest litigation seeking a court-monitored CBI investigation into an alleged "cash-for-transfers" and institutional corruption racket linked to the Punjab Chief Minister's Office.

The PIL contains allegations of illegal gratification in connection with the transfers and postings of government officers. It also alleges interference in administrative decisions and influence over government tenders, contracts, licences and approvals. Other allegations placed before the court relate to Change of Land Use (CLU), land-related matters, alleged facilitation of certain builders and developers, and financial transactions that the petitioner claims involved quid pro quo arrangements.

The petitioner has relied on a communication allegedly sent by the Directorate of Enforcement to the Punjab Director General of Police and has sought the transfer of the investigation to the CBI. The plea argues that the allegations concern individuals who allegedly hold or exercise influence at senior levels within the state administration. The petitioner has sought an independent investigation under the supervision of the High Court, citing the nature and scope of the allegations.

In its response, the CBI maintained that it would not be appropriate for the agency to comment at this stage on the correctness, veracity or merits of the allegations. The central agency also declined to offer an opinion on the material relied upon by the petitioner or on allegations concerning the conduct, action or inaction of Punjab Police and vigilance authorities. Its response therefore does not amount to confirmation of any of the allegations raised in the PIL.

The CBI informed the High Court that the question of whether the circumstances warrant entrusting the investigation to the central agency is for the court to decide while exercising its constitutional jurisdiction. The agency, however, made it clear that if the High Court orders it to conduct the probe, it has no objection and would proceed in accordance with law and the directions issued by the court.

The agency further indicated that, if such an order is passed, appropriate directions could be issued to the concerned authorities and agencies for preserving and handing over records, documents, electronic data and other material required for the investigation. The matter remains before the Punjab and Haryana High Court, which will consider the pleadings and material on record before deciding whether the allegations warrant an independent CBI probe.
