Bombay HC Orders Fast Decision on Visa Extension For Yemeni Man on Humanitarian Grounds

The Bombay High Court has directed authorities to take a timely decision on the visa extension application of a Yemeni national detained for overstaying in India, granting relief on humanitarian grounds. The court instructed officials to resolve the matter within eight weeks, emphasizing the need for a compassionate approach given the individual’s personal circumstances and the ongoing conflict in his home country.

The case was brought before the court by the man’s Indian wife, who filed a habeas corpus petition after he was initially detained by Pune police. She argued that her husband’s continued stay in India should be regularised, citing the severe instability in Yemen and the potential consequences of forced separation from their family. The couple has two children, and the plea highlighted the emotional and practical challenges that deportation could pose.

During the proceedings, the petitioner contended that denying the visa extension would effectively separate the family permanently, as the husband may not be able to safely return to India or reunite with his children in the future. The argument stressed that humanitarian considerations should take precedence, especially in cases involving conflict-affected regions and dependent family members residing in India.
