SC Reserves Judgment on Duraisamy’s Petition Over MK Stalin’s 2011 Victory
Supreme Court reserves its order on Duraisamy’s plea challenging MK Stalin’s 2011 Assembly election victory.
The Supreme Court of India on Thursday reserved its order on a petition filed by Duraisamy, challenging the 2011 Assembly election victory of M. K. Stalin. The plea questions the validity of Stalin’s win from the Kolathur constituency during the 2011 Tamil Nadu Assembly elections.
A bench of the apex court heard arguments from both sides before reserving its judgment. The petitioner has reportedly raised issues related to alleged irregularities in the nomination process and compliance with election disclosure norms. The matter has been under judicial scrutiny for several years, given the protracted legal proceedings associated with election petitions.
Counsel representing Stalin argued that the election was conducted in accordance with established procedures and that the plea lacked merit. The defence maintained that there was no material evidence to substantiate claims of impropriety and urged the court to dismiss the petition.

The case stems from the 2011 Tamil Nadu Assembly elections, in which Stalin, a senior leader of the Dravida Munnetra Kazhagam (DMK), secured victory from Kolathur. The election marked a significant phase in his political career, eventually culminating in his rise to the chief minister’s post in 2021.
Election petitions often involve detailed examination of nomination papers, affidavits, and procedural compliance under the Representation of the People Act. Legal experts note that while such challenges are not uncommon, courts typically require clear evidence of substantial violation that materially affects the election outcome.
With the Supreme Court having reserved its order, the final ruling is awaited. The judgment could clarify the legal thresholds applicable in election disputes and reinforce precedents governing challenges to electoral victories.
