PM Included in Jail-Resignation Law: Shah
PM Modi includes himself in law to sack jailed ministers.
Union Home Minister Amit Shah defended the Constitution (130th Amendment) Bill, 2025, on Monday, countering Opposition criticism by highlighting that Prime Minister Narendra Modi has included himself in the proposed law, which mandates resignation for jailed leaders. Speaking to ANI, Shah emphasized, “PM Modi has brought a constitutional amendment against himself. If the Prime Minister goes to jail, he will have to resign.”
Introduced last week alongside the Government of Union Territories (Amendment) Bill, 2025, and the Jammu and Kashmir Reorganisation (Amendment) Bill, 2025, the legislation stipulates that the Prime Minister, Union ministers, or state Chief Ministers must vacate their office if detained for 30 days or more for an offense carrying a minimum five-year sentence. The rule applies automatically on the 31st day of custody.
Shah sharply criticized the Opposition’s “black bill” protests, accusing them of undermining democratic dignity. “Can a Chief Minister or Prime Minister run the country from jail? The jail will become the Chief Minister’s House or Prime Minister’s House, with officials taking orders from there. My party and I reject this idea,” he said, dismissing claims that the country cannot function without specific leaders.

Addressing concerns about political motives, Shah clarified that the law would not affect parliamentary or assembly majorities. “One member goes, others from the party will govern. If they get bail, they can return and take the oath again,” he explained. He also condemned the Opposition’s disruptive protests in Parliament, questioning, “Are both Houses meant for discussion or just noise?” Shah noted that the bill would be reviewed by a joint committee, allowing all parties to voice their opinions before a two-thirds majority vote required for constitutional amendments.
The Opposition alleges the bill targets non-BJP governments, but Shah’s remarks underscore the government’s commitment to upholding democratic principles through this bold legislative move.
