Madhya Pradesh government approves long-delayed promotions for state employees
The Madhya Pradesh government has cleared the way for long-pending promotions of state government employees, bringing to an end a decade-long administrative impasse caused by multiple legal disputes over promotion rules. The move is expected to benefit thousands of employees across departments while also creating a significant number of vacancies for fresh appointments.
The state's General Administration Department (GAD) on Tuesday issued a notification to additional chief secretaries, principal secretaries, heads of departments and district collectors, directing them to initiate the promotion process under the Madhya Pradesh Public Service Promotion Rules, 2025. The decision is based on the legal opinion provided by Advocate General Prashant Singh after consulting senior advocate C.S. Vaidyanathan, who has represented the state in cases challenging the promotion rules before the Madhya Pradesh High Court.
According to the notification, the Advocate General sought Vaidyanathan's legal opinion to clarify whether promotions could proceed despite the ongoing litigation. The government has instructed all departments to take necessary action in accordance with the legal advice received. The opinion concluded that there is no interim order from the High Court staying the implementation of the Promotion Rules, 2025, thereby allowing the state to move forward with the long-delayed exercise.

The legal opinion further clarified that the government's earlier assurance before the High Court not to conduct promotions was neither incorporated into any judicial order nor officially recorded in court proceedings. As a result, the opinion states that there is no legal bar on constituting Departmental Promotion Committees (DPCs) and carrying out promotions under the new rules. However, it also makes clear that all promotions will remain subject to the final verdicts of the Madhya Pradesh High Court and the Supreme Court in the pending cases related to the promotion policy.
The development assumes particular significance as several government departments are currently operating with only 30 to 40 per cent of their sanctioned workforce due to the prolonged absence of promotions. Officials believe that filling higher-level posts through promotions will improve administrative efficiency and streamline decision-making across departments. At the same time, promotions are expected to create between one lakh and 1.5 lakh vacancies annually in lower cadres, opening opportunities for fresh recruitment into government service.
The issue has remained unresolved since 2016, when multiple petitions challenging the state's promotion rules were filed before the High Court. During the prolonged litigation, promotions across departments remained largely stalled, resulting in an estimated two lakh to 2.5 lakh government employees retiring over the past decade without receiving promotions they had been awaiting.
Under the latest notification, departments have been instructed to implement the exercise in accordance with the 2025 Rules. They have been directed to identify cadre-wise vacancies reserved for Scheduled Castes, Scheduled Tribes and unreserved categories under Rule 5 of the Promotion Rules. Departments must also prepare updated seniority lists extending up to 2029 and submit them to the General Administration Department for further processing.
While the promotion process is now set to begin, the government has reiterated that every promotion granted under the new rules will remain subject to the final outcome of the cases pending before the High Court and the Supreme Court. Nevertheless, the decision marks a major administrative breakthrough, ending nearly ten years of uncertainty and paving the way for long-awaited career progression for thousands of government employees across Madhya Pradesh.
