Supreme Court Halts UGC's New Equity Rules, 2012 Norms Back in Place

Supreme Court stays UGC's 2026 equity regulations, directs institutions to follow 2012 norms until further orders.

The Supreme Court stayed the implementation of the University Grants Commission’s (UGC) new regulations aimed at promoting equity in higher education today. The interim order comes amid widespread protests and criticism, particularly from sections of the general category, over the potential impact of the new rules on campuses across India.

A Bench of the apex court directed all higher education institutions to continue following the UGC Regulations, 2012, until further orders are passed. The court also issued notices to the Centre and the UGC, listing the matter for further hearing on March 19. The stay was granted by invoking the Supreme Court’s special powers under Article 142 of the Constitution.

During the proceedings, the court expressed concern over the language used in the new regulations. Observing that the wording could allow for potential misuse, the Bench noted that vague provisions may create unintended consequences rather than ensuring fairness and inclusivity in academic institutions.

Justice Bagchi, while underscoring the importance of building an equitable and inclusive social environment, questioned the necessity of introducing new classifications. He remarked that when existing frameworks already address equity concerns, the relevance of additional concepts introduced by the regulations needs careful examination.

The disputed regulations, notified by the UGC on January 13, mandate the formation of equity committees in all higher education institutions. These committees are required to include members from OBC, Scheduled Caste, and Scheduled Tribe communities and are tasked with addressing complaints of discrimination and promoting inclusion on campuses.

Following the notification, protests erupted nationwide, with critics alleging that the UGC Regulations, 2026, could deepen caste-based divisions and adversely affect the academic atmosphere. The Supreme Court’s stay will remain in effect until the next hearing, providing temporary relief while the legal and constitutional validity of the rules is examined.
