Supreme Court Suspends Madras HC Order On Cow Slaughter Ban In Tamil Nadu

The Supreme Court on Monday stayed a Madras High Court order that had directed a statewide ban on the slaughter of cows and calves in Tamil Nadu. The interim order came after the Tamil Nadu government, led by Chief Minister Vijay's Tamilaga Vettri Kazhagam (TVK), approached the apex court challenging the High Court's directions.

The Supreme Court's intervention temporarily halts the implementation of the disputed order while the matter is examined. A bench comprising Justices Vikram Nath and Sandeep Mehta issued notice on the Special Leave Petition filed by the Tamil Nadu government and passed the interim stay.

During the hearing, the bench observed that the final paragraph of the Madras High Court's order, which imposed the statewide ban, appeared to require correction. The court's observations were made while considering the state's challenge to the earlier judgment. The Tamil Nadu government had moved the Supreme Court against the Madras High Court's May 27 order, which directed the state's Chief Secretary and Director General of Police to ensure that no cow or calf was slaughtered anywhere in Tamil Nadu.

The High Court had issued the direction ahead of Bakrid on May 28 and stated that the prohibition would apply on that occasion as well as on other days. In its petition before the Supreme Court, the state government argued that the High Court's directions contained inconsistencies. The government said the High Court had correctly noted that animal slaughter could only take place at authorised slaughterhouses under existing regulations.  However, it argued that the additional direction prohibiting the slaughter of cows and calves on Bakrid or any other day went beyond that framework and created a contradiction.

The legal dispute involves questions related to the regulation of animal slaughter, enforcement powers of the state administration and the balance between statutory restrictions and religious practices. The Supreme Court's interim order means that the High Court's statewide prohibition will not remain operational until the apex court further examines the legal issues raised by the Tamil Nadu government. The Madras High Court order had followed a petition seeking directions regarding the slaughter of cows and calves in the state.

The court had instructed senior government officials to ensure compliance with its directions, including preventing slaughter during Bakrid celebrations. The order had attracted attention due to its wider implications for animal protection measures and religious customs. The Supreme Court will now hear arguments from the Tamil Nadu government and other parties before taking a further view on the matter. Until then, the interim stay remains in force, and the legal position will depend on the final outcome of the proceedings before the apex court. The case is expected to be closely watched due to its implications for animal welfare regulations and governance powers in the state.
