Supreme Court Raps Authorities Over Illegal Constructions In Delhi-NCR And Beyond

SC criticises authorities over illegal construction enforcement.

The Supreme Court on Thursday sharply criticised authorities over the continued proliferation of unauthorised constructions in Delhi-NCR and other parts of the country, observing that officials were carrying out only “face-saving exercises” instead of taking meaningful action against those responsible for permitting illegal buildings. The court warned that it would hold government officials personally accountable if they failed to address the violations. A bench comprising Justices Ahsanuddin Amanullah and Sheel Nagu expressed dissatisfaction with the manner in which authorities have dealt with illegal constructions, stating that enforcement agencies have largely targeted builders while ignoring public officials responsible for monitoring development and enforcing building regulations.

“Only face-saving exercises are being done, where only builders, etc., are being apprehended and not the officials who are in charge of areas where rampant violations have happened. We reiterate the concern of this court as indicated on May 20,” the bench observed, according to Bar & Bench. The court recalled its earlier order issued on May 20, in which it had highlighted widespread building violations in Delhi's Lajpat Nagar and Sarojini Nagar.  At the time, the bench observed that many unauthorised structures were inherently unsafe because they were constructed without adhering to approved plans and were unable to withstand the excessive loads placed upon them through illegal additions and alterations.

Expressing concern over recurring incidents involving unsafe buildings, the Supreme Court referred to recent cases of fires and structural collapses, including the Malviya Nagar fire, the Lucknow fire and the Saket building collapse. The bench noted that despite its earlier directions, authorities had failed to take effective corrective measures. “We hoped that the officials would take action, but nothing happened,” the judges remarked, indicating their dissatisfaction with the response from civic authorities and other government agencies responsible for enforcing building regulations. The bench warned that responsibility for illegal construction could not rest solely with private builders and developers.

It emphasised that government officials tasked with approving plans, inspecting construction and preventing violations must also be held accountable when unauthorised structures are allowed to come up unchecked. The court indicated that it may issue stringent directions against officials found to have neglected their duties or facilitated illegal construction through inaction. It said personal accountability would be enforced to ensure that authorities discharge their statutory responsibilities effectively rather than merely taking symbolic action after violations come to light.

Illegal constructions have remained a persistent challenge in Delhi-NCR and several other urban centres, often resulting in overcrowding, compromised structural safety and increased fire risks.  Courts have repeatedly expressed concern over unauthorised buildings, particularly those erected without adherence to safety norms, sanctioned plans or municipal regulations. The Supreme Court's observations underscore growing judicial concern over administrative lapses in urban planning and building regulation. The matter is expected to remain under the court's scrutiny, with authorities likely to be required to submit details of enforcement measures and action taken against both erring builders and public officials responsible for allowing illegal constructions to flourish.
