Supreme Court Orders Samay Raina and Comedians to Host Monthly Events for Disability Aid Fund

SC directs Samay Raina and other creators to hold fundraising events for persons with disabilities.

The Supreme Court of India has mandated stand-up comedian Samay Raina and several other content creators to hold at least two fundraising events every month to support a special fund dedicated to the treatment of persons with disabilities. The order was pronounced by a bench comprising Chief Justice Surya Kant and Justice Joymalya Bagchi during a hearing of a petition filed by Cure SMA India Foundation, which seeks action against online content it alleges violates the dignity and rights of persons with disabilities.

The petition highlighted insensitive remarks made by Raina and others, including jokes about the high cost of treatment for Spinal Muscular Atrophy (SMA), and the alleged mockery of disabled individuals. The Court acknowledged the gravity of such content and took note of the comedians’ voluntary commitment to launch programs that raise awareness and funds while featuring positive stories of people with disabilities. The bench emphasized that the comedians should encourage persons with disabilities to participate and showcase their achievements, thereby promoting dignity and support for timely treatment.

In its order, the Supreme Court stated, "We hope and expect that such few memorable events will take place before we hear the matter on the next date. Let such two programs be held twice a month." The Court’s directive underscores a broader attempt to bridge gaps in empathy and practical assistance through accountable use of public platforms by influential content creators.

This directive comes after previous rulings where the Supreme Court summoned Samay Raina and other influencers over allegations of ridiculing persons with disabilities, insisting on stringent measures to prevent such "damaging" and "demoralising" content. In August, the comedians were ordered to issue public apologies and were cautioned against underestimating the seriousness of the matter.

The Cure SMA India Foundation continues to advocate for regulatory frameworks that protect disabled persons from hurtful or belittling online content. The Court's actions reflect a commitment to uphold the dignity of marginalized groups and to hold digital content creators responsible in shaping respectful, inclusive narratives.​
