Supreme Court Intervenes to Pause Kokate’s Conviction in Cheating and Forgery Case

Supreme Court of India has intervened to stay the conviction of former Maharashtra minister Manikrao Kokate in a case involving cheating and forgery. This decision, delivered on Monday by a vacation bench, provides temporary relief to Kokate, preventing immediate disqualification from his position as a member of the legislative assembly. The court's order ensures that while the conviction is paused in terms of its disqualifying effects, Kokate is barred from holding any office of profit during this period.

The bench, comprising Chief Justice Surya Kant and Justice Joymalya Bagchi, issued a notice to the Maharashtra government seeking its response to Kokate's plea challenging the lower court's rulings. This procedural step allows for a detailed examination of the arguments presented by the petitioner, highlighting the judiciary's commitment to thorough review in matters affecting public representatives. Kokate's legal troubles stem from a magistrate court's decision in February this year, which imposed a two-year sentence on him for his alleged involvement in dishonestly inducing the state government to allot flats to him and his brother. This conviction was subsequently upheld by the Nashik sessions court just last Tuesday, reinforcing the findings of cheating and forgery.
