Supreme Court Halts Further Action in Sandesara Case After Full Settlement is Honoured

The Supreme Court questioned the ongoing action against the Sandesaras after the full Rs 5,100 crore settlement was paid.

The Supreme Court of India has raised questions over the need for further action in the Sandesara case following a ₹5,100 crore settlement, noting that the primary objective of recovering public money appears to have been achieved. The court’s observations came during a hearing that also involved lenders seeking clarity on the next steps after the settlement.

The bench pointed out that the originally calculated dues in the case were around ₹1,700 crore, but a significantly higher consolidated settlement of ₹5,100 crore was reached in the public interest. The Sandesara brothers have accepted and fully paid the agreed amount, which the court said reflected a clear intention to resolve the matter and return substantial funds to the banking system.

Following the settlement, the court ordered the quashing of criminal proceedings, indicating that continued legal action may no longer be necessary. It questioned how further proceedings—particularly by regulatory bodies—could be justified once the settlement had been honoured and legal closure granted.

The court also heard submissions from lenders led by the State Bank of India regarding the distribution of the recovered funds. It emphasised that safeguarding public money remains the central objective and observed that prolonging proceedings may not serve any meaningful purpose now that the funds have been returned to the banks.
