Supreme Court Allows Conditional OCs in Noida’s Sector 150, Paving Way for Registries and Possession

SC allows conditional OCs in Noida’s Sector 150, reviving stalled Sports City projects and aiding homebuyers.

In a significant relief for thousands of homebuyers who have been waiting over a decade, the Supreme Court has directed the Noida Authority to issue conditional occupancy certificates and permit property registries for completed apartments in Sector 150’s Sports City project. A bench of Justices MM Sundresh and Satish Chandra Sharma, in its November 24 order, accepted a comprehensive resolution framework submitted by the authority and original allottee Lotus Green Constructions Pvt Ltd (LGCPL), paving the way to revive the long-stalled 300-acre development that houses nearly 20,000 residential units across 24 sub-developers.

The court-mandated plan lifts the January 2021 ban imposed after a CAG audit exposed massive irregularities, including underpriced land allotments worth over ₹9,000 crore to the exchequer and developers’ failure to build promised world-class sports infrastructure. Key conditions include LGCPL submitting a revised master plan within 30 days, the authority approving it within 45 days, and developers clearing 20 per cent of outstanding dues before building-plan approvals. Sports facilities must be completed within three years and all infrastructure within five years of the revised plan’s approval, with developers also granted “zero-period” relief for delays caused by Covid-19 and the 2021 freeze.

Occupancy certificates will be issued only after full dues are settled and construction is completed as per approved plans, while the Noida Authority retains first charge and lien over 20 per cent of units in each tower as security until complete repayment. Developers are permitted to rope in joint-venture partners or co-developers—similar to successful models in other Noida sectors—to accelerate funding and construction. The authority’s board has been given four weeks to formally ratify the resolution, following which the 2021 restrictions will be removed within 30–45 days.

The breakthrough has been hailed by homebuyers and industry bodies as a decisive step toward ending a decade-long ordeal that began when land was allotted between 2011 and 2015 under the Sports City scheme, promising 70 percent sports facilities alongside luxury housing. CREDAI Western UP president Dinesh Gupta welcomed the “clear timelines and payment model”, stating it will accelerate work and restore buyer confidence in Noida’s real estate market. Similar resolution frameworks are expected soon for stalled Sports City projects in sectors 78, 79, and another portion of Sector 150, offering hope to thousands more affected families.
