Saurav Das Flags Free Speech Debate After Woman Faces Case Over PM Modi Remarks

Cockroach Janta Party (CJP) spokesperson Saurav Das on Friday criticised the filing of an FIR against a woman accused of making abusive remarks against Prime Minister Narendra Modi during a protest at Jantar Mantar, calling it an alleged misuse of criminal machinery. Das questioned the legal basis of the action and defended the woman, saying that registering a criminal case over political speech raised concerns about freedom of expression. The controversy began after a video from the Jantar Mantar protest on July 23 surfaced on social media, allegedly showing the woman making offensive remarks against Prime Minister Modi.

Following a complaint filed by a Ghaziabad resident, police registered a case against her under relevant legal provisions, including charges related to intentional insult, public mischief and defamation. Police officials said the complaint was initially filed at the Expressway police station in Noida. A "zero FIR" was registered before being transferred to the Parliament Street police station in New Delhi for further investigation, as the alleged incident took place during a protest in the national capital.

A zero FIR allows police to register a complaint regardless of jurisdiction before transferring it to the appropriate police station. Reacting to the development, Saurav Das questioned the decision to initiate criminal proceedings against the woman. "When did it become criminal offense?" he said while criticising the police action. He alleged that the FIR represented an improper use of legal provisions against an individual for expressing views during a political demonstration. The case has brought renewed attention to the legal boundaries surrounding public speech, political criticism and alleged offensive statements against public figures.

While individuals have the right to express political opinions, authorities can take action when statements are alleged to violate applicable laws related to public order, defamation or other offences. The Jantar Mantar protest, where the alleged remarks were made, was held on July 23 and witnessed participation from individuals raising political issues. The incident gained attention after the video circulated online, leading to a complaint and subsequent police action. Authorities have not announced any further details about the investigation or whether additional statements will be recorded. The matter is now being examined by the Delhi Police after the transfer of the FIR from Noida.

Investigators are expected to review the available evidence, including the video footage and statements related to the complaint, before deciding the next course of action. The controversy has also triggered a wider political debate, with supporters of the complainant arguing that legal action is necessary against alleged abusive remarks, while critics, including Das, questioning whether criminal proceedings are appropriate in such cases. The investigation will determine the facts surrounding the complaint and the applicability of the charges registered against the woman.
