Rahul Gandhi Fights Varanasi Court in High Court

Congress leader challenges order over controversial Sikh remarks.

Congress leader Rahul Gandhi has filed a revision petition in the Allahabad High Court, challenging a Varanasi special MP-MLA court’s order that directed a subordinate court to reconsider an application seeking an FIR against him. The application, filed by Varanasi resident Nageshwar Mishra, relates to alleged objectionable remarks Gandhi made about Sikhs during a September 2024 visit to the United States. The matter is slated for hearing before Justice Sameer Jain’s single bench on September 1, 2025.

The controversy stems from Gandhi’s alleged statement during a US event, where he reportedly claimed that the environment in India is unfavorable for Sikhs. The remarks sparked widespread protests and were labeled “provocative and divisive” by critics. Mishra attempted to register an FIR at Varanasi’s Sarnath police station, but when his efforts failed, he approached the Additional Chief Judicial Magistrate (ACJM MP-MLA) in Varanasi. On November 28, 2024, the ACJM rejected Mishra’s application, citing that the speech was delivered in the US, placing it outside the court’s jurisdiction.

Mishra challenged this dismissal in the sessions court, and on July 21, 2025, the Special Judge (MP/MLA) overturned the ACJM’s decision, directing a fresh hearing. Gandhi’s legal team now argues in the Allahabad High Court that the special court’s order is “wrong, illegal, and without jurisdiction,” seeking to quash the directive. The petition contends that the Varanasi court overstepped its authority, given the extraterritorial nature of the alleged offense.

The case has reignited debates over freedom of speech, political accountability, and the judiciary’s role in handling sensitive public statements. Gandhi’s remarks, perceived by some as an attempt to highlight minority concerns, have drawn sharp criticism from others who view them as divisive. As the Allahabad High Court prepares to hear the case, all eyes are on whether the judiciary will uphold the Varanasi court’s directive or rule in favor of Gandhi, potentially setting a precedent for handling such disputes. The outcome could have significant implications for the Congress leader’s public image and the broader political discourse in India.
