Punjab Government Ordered To Clear Pending Dearness Allowance Dues Within Fifteen Days By Court

In a significant relief for nearly six lakh Punjab government employees and pensioners, the Punjab and Haryana High Court has directed the Punjab government to clear pending Dearness Allowance (DA) arrears within 15 days. The court issued the direction after dismissing the state's Letters Patent Appeal (LPA), effectively upholding an earlier order that mandated the release of the outstanding dues. The High Court reaffirmed that the Punjab government is liable to pay the pending DA arrears to eligible employees and pensioners. The order is expected to have major financial implications for the state, with the estimated liability for the arrears standing at approximately Rs 14,191 crore.

According to the court's directions, the state government must ensure that the arrears are released within 15 days. The Chief Secretary has also been asked to submit an affidavit before the court after the payments are completed, confirming compliance with the order. The court upheld the earlier ruling of a single-judge bench, rejecting the government's appeal against the decision. With the dismissal of the LPA, the legal challenge mounted by the state against the payment of arrears has effectively failed, clearing the way for employees and pensioners to receive their dues.

In another important observation, the High Court directed the Punjab government to refrain from spending on advertisements and other non-essential schemes until the pending DA arrears are cleared. The restriction is aimed at ensuring that the government prioritises the payment of dues owed to employees and pensioners. The order further stated that if the government fails to make the payments within the stipulated period, the outstanding amount would attract an annual interest rate of 6 per cent. The provision could significantly increase the state's financial burden if the dues are not cleared within the deadline set by the court.

Dearness Allowance is a cost-of-living adjustment paid to government employees and pensioners to offset the impact of inflation. Delays in releasing DA instalments or arrears often become contentious issues, particularly when inflation rises and employees seek timely revisions in compensation. The ruling is expected to bring relief to a large section of serving and retired government personnel in Punjab who have been awaiting the release of the pending amounts. Employee organisations have long demanded that the state clear the arrears, arguing that the delay had caused financial hardship to many families.

At the same time, the order presents a major fiscal challenge for the Punjab government, which will now have to arrange funds to meet the sizeable liability. The estimated Rs 14,191 crore payout comes at a time when the state is already dealing with financial pressures and competing expenditure commitments. The government has not yet publicly indicated whether it will seek any further legal remedy or how it plans to comply with the order. However, with the High Court's latest direction in force, the administration is now under pressure to release the dues and file a compliance affidavit within the prescribed timeframe.
