Pawan Khera Granted One-Week Anticipatory Bail By Telangana High Court

Telangana High Court grants Pawan Khera one-week anticipatory bail in Assam-linked case.

The Telangana High Court on Friday granted interim anticipatory bail for one week to Congress leader Pawan Khera in connection with an FIR registered by Assam Police over alleged objectionable remarks linked to the wife of Assam Chief Minister Himanta Biswa Sarma, providing him temporary protection from arrest while he approaches the jurisdictional court in Assam.

The order was passed by Justice Sujana Kalasikam, who observed that the relief was limited in nature and intended only to allow the petitioner sufficient time to move the competent court in Assam for regular anticipatory bail. The court directed that Khera be given one week to file the application and granted interim protection from coercive action during this period, subject to compliance with conditions imposed by the bench.

According to the case details, the Assam Police registered the FIR at the Guwahati Crime Branch Police Station following complaints arising from statements allegedly made by Khera regarding the Chief Minister’s wife. The police invoked multiple provisions of the Bharatiya Nyaya Sanhita (BNS), including sections relating to false statements in connection with elections, cheating, and provisions connected to legal rights concerning private defence, as part of the investigation.

During the hearing, Khera’s legal team reportedly argued that the proceedings were politically motivated and sought protection from immediate arrest, contending that he intended to pursue legal remedies in the appropriate court in Assam. The court, while not commenting on the merits of the allegations, accepted the request for interim relief purely on procedural grounds, ensuring that the accused is not arrested during the limited window provided.

The High Court’s decision effectively shifts the next stage of the legal battle to Assam, where Khera is expected to file a regular anticipatory bail petition before the competent court. That court will examine the FIR, the allegations, and the merits of granting continued protection from arrest while the investigation proceeds.

The case has added to ongoing political tensions between the Indian National Congress and the Bharatiya Janata Party, with both sides frequently engaging in sharp exchanges over legal and political controversies. Further developments will depend on the outcome of the bail application in Assam and any subsequent police action in the investigation.
