Patna High Court Sets Aside Bihar Govt Order, Restores Pappu Yadav Y+ Security

Patna High Court restored Pappu Yadav’s Y+ security cover, ruling Bihar government’s downgrade arbitrary and unjustified.

The Patna High Court has restored the ‘Y+’ security cover of Independent Lok Sabha MP Rajesh Ranjan, popularly known as Pappu Yadav, setting aside the Bihar government’s decision to downgrade his security to the ‘Y’ category, terming the move “arbitrary and whimsical” and not in line with principles of natural justice.

The order was issued by a single-judge Bench of Justice Jitendra Kumar, who directed the state’s Home Secretary to immediately reinstate the higher level of security protection that had earlier been granted to the Purnia MP. The court was hearing a petition filed by Yadav, who had sought enhancement of his security cover citing alleged threats to his life from criminal groups, including those linked to jailed gangster Lawrence Bishnoi and others.

According to the court’s findings, the Bihar government had downgraded the MP’s security cover in September 2025 without adequate reasoning or procedural fairness. The judge noted that the decision was not supported by relevant material indicating a reduced threat perception and that no input or explanation had been sought from the MP before the downgrade was ordered.

The court further observed that the government had also failed to communicate the decision properly and had relied primarily on a report from the Superintendent of Police, Purnia. However, the report itself did not conclude that the threat level had decreased, only noting that Yadav had not formally lodged complaints regarding the alleged threats.

Describing the process as lacking fairness, the High Court emphasized that decisions affecting personal safety must comply with constitutional principles and natural justice. It stated that executive actions involving security assessments must be based on objective material and proper consultation with relevant stakeholders. The court has also directed the Bihar government to reconsider the MP’s request for enhanced security afresh, taking into account inputs from both Yadav and security agencies, and to issue a reasoned order in accordance with law.
