Odisha Women Gain Night Shift Rights

In a landmark move to enhance employment opportunities for women, the Odisha government has amended the Odisha Shops and Commercial Establishments Act, 1956, to allow women to work night shifts in factories, shops, and commercial establishments. The decision, formalized through a notification by the Labour and Employees' State Insurance Department, mandates written consent from women employees to ensure their willingness to work night shifts.

The guidelines prioritize safety and security, stipulating that at least three women must be present during any night shift. Employers are required to provide GPS-equipped transportation for safe pick-up and drop-off, along with dedicated facilities such as well-lit toilets, washrooms, and drinking water stations near workplaces. These areas must be monitored by CCTV surveillance to ensure a secure environment. The notification explicitly prohibits adolescent women from working night shifts, reinforcing protections for younger workers.

Labour Minister Ganesh Ram Singkhuntia emphasized the progressive intent of the policy, stating, “Following directives from the Centre, we have enabled women to work at night with their written consent, opening new avenues for employment while prioritizing their safety.” The move aligns with efforts to promote gender equality in the workforce and boost economic participation.

However, the opposition Biju Janata Dal (BJD) criticized the policy, with leader Pramila Mallik arguing that the self-declaration requirement shifts responsibility onto women to ensure their own safety. “This absolves the government of accountability,” Mallik claimed, sparking debate over the balance between empowerment and employer responsibility.

The initiative is expected to create a more inclusive workforce in Odisha, provided employers adhere to the stringent safety protocols outlined.
