Court Orders Charges In IRCTC Case

A Delhi court has ordered the framing of money laundering charges against former Bihar chief minister Lalu Prasad Yadav, his wife Rabri Devi and their son Tejashwi Yadav in the IRCTC hotel scam case. The order was passed by Special Judge Vishal Gogne, who orally observed that there was a “strong suspicion of abuse of office and proceeds of crime” in the case. The court's observations relate to alleged transactions involving land and the awarding of contracts for two IRCTC hotels during Lalu Prasad Yadav's tenure as Union railway minister.

The case centres on alleged irregularities in the awarding of contracts for the operation and maintenance of two hotels owned by the Indian Railway Catering and Tourism Corporation (IRCTC). The alleged transactions date back to the period between 2005 and 2014, when Lalu Prasad Yadav served as the Union railway minister. Investigating agencies have alleged that the hotel contracts were awarded in exchange for an arrangement involving land in Patna. The subsequent money laundering proceedings examine whether the alleged proceeds of the offence were acquired, transferred or dealt with in a manner covered under the Prevention of Money Laundering Act.

During the proceedings, the court specifically referred to land in Patna that Rabri Devi and Tejashwi Yadav allegedly continue to enjoy. The court described the property as “tainted land” and observed that it had been transferred to them at the behest of Lalu Prasad Yadav. The alleged transfer is part of the prosecution's case concerning the benefit said to have been obtained through the transactions linked to the hotel contracts. The court's oral observation of a “strong suspicion of abuse of office and proceeds of crime” formed an important part of its consideration while ordering the framing of charges.

The allegations relate to Lalu Prasad Yadav's position as railway minister and the manner in which contracts connected with IRCTC properties were allegedly awarded. According to the prosecution's case, private parties benefited from the hotel contracts while land transactions involving individuals connected with the Yadav family formed part of the alleged quid pro quo. The money laundering case consequently examines not only the original alleged irregularities but also the movement and possession of assets said to represent proceeds connected with those offences.

The court's order to frame charges represents a significant procedural development but does not amount to a conviction. At the stage of framing charges, the court determines whether there is sufficient material and grounds to proceed against the accused. The allegations made by the investigating agencies will therefore have to be established through the evidence and subsequent proceedings. Lalu Prasad Yadav, Rabri Devi and Tejashwi Yadav will have the opportunity to contest the allegations as the trial progresses.

The case has also carried considerable political significance because Lalu Prasad Yadav and Rabri Devi have served as chief ministers of Bihar, while Tejashwi Yadav is a prominent leader of the Rashtriya Janata Dal. The latest order places the alleged land transactions and the IRCTC hotel contracts under renewed judicial scrutiny. With the Delhi court directing that money laundering charges be framed against the three members of the Yadav family, the proceedings will now move forward, with the prosecution required to substantiate its allegations and the accused continuing to defend themselves before the court.
