The Delhi High Court on Wednesday asked the Central Government to consider an acid attack survivor’s plea seeking disability benefits, underlining the broader challenges faced by survivors of such brutal crimes and the need for more inclusive state support.

A division bench led by Chief Justice Manmohan and Justice Manoj Jain directed the Centre to examine whether the petitioner, who sustained life‑altering injuries in an acid attack, could be classified as a person with disability eligible for benefits under the Rights of Persons with Disabilities Act, 2016. The court’s order came during a hearing on the survivor’s plea, which argued that current assessments and classifications did not adequately recognise the severe physical and psychological impact of acid attacks.

The petitioner contended that the physical disfigurement, loss of vision, and other impairments resulting from the attack should qualify as disabilities under existing legal frameworks. His counsel urged the court to instruct the government to revise its disability evaluation criteria to consider the long‑term effects of acid attack injuries, including functional limitations and social stigma that survivors often endure.

During the hearing, the bench observed that survivors of acid attacks frequently suffer from multiple forms of disability, including disfigurement, physical impairment, and psychological trauma, and that the law’s objective is to ensure dignity, rehabilitation, and equal opportunities for persons with disabilities. The judges noted that the Central Government’s stand on the classification was crucial for determining appropriate relief and entitlements for the petitioner.

The court did not pass a final order on the plea but insisted that the Centre review the matter expeditiously within a reasonable timeframe and communicate its decision to the registry. The bench emphasised the importance of fair and humane consideration for survivors who face lifelong challenges due to violent crimes.

Legal experts said the case highlights ongoing debates over how disability laws are implemented in India and whether current guidelines sufficiently reflect the complex realities of survivors of extreme violence. The High Court’s direction is seen as a potential step toward more inclusive policymaking for victims of acid attacks and other disfiguring injuries.
