Delhi Court Rejects BMW Crash Accused’s Plea for CCTV Disclosure

A Delhi court on Friday firmly rebuffed a plea by Gaganpreet Kaur, the 38-year-old accused in a fatal BMW crash, to force police to disclose details of critical CCTV evidence. The ruling came during a hearing before Judicial Magistrate Ankit Garg, who emphasized that the prosecution cannot be compelled to reveal the "veracity and contents" of evidence to the accused, in a case that has gripped the capital with its tragic outcome and allegations of foul play.
Kaur, allegedly behind the wheel of a BMW that slammed into a two-wheeler on September 14, 2025, in Dhaula Kuan, killed Navjot Singh, a 52-year-old Deputy Secretary in the Department of Economic Affairs, and left his wife gravely injured. The couple was returning from Bangla Sahib Gurdwara when the crash occurred near Delhi Cantonment Metro station on Ring Road. Kaur, now in judicial custody until September 27, faces charges under the Bharatiya Nyaya Sanhita for rash driving, endangering lives, culpable homicide not amounting to murder, and causing disappearance of evidence.
Kaur’s counsel, Gagan Bhatnagar, argued that the case hinges on CCTV footage from metro pillars 65 and 67, pressing for its preservation and scrutiny. The court, however, noted that orders to preserve the footage were already issued, with the Delhi Cant Station House Officer (SHO) confirming that the relevant footage, covering the incident site, is secured in the police malkhana. The court directed the SHO to clarify whether footage from the specified pillars is included, but firmly rejected Kaur’s demand for detailed disclosure, stating, “The accused cannot ask the prosecuting agency to make a statement about the evidence collected.”

The matter, now set for further hearing on September 20 alongside Kaur’s bail plea, has sparked debate over transparency in high-profile cases.
