US Expands Online Presence Reviews for All H-1B and H-4 Visa Applicants

The US State Department expands digital vetting of H-1B and H-4 applicants to prevent misuse of the visa programme.

The United States Department of State has issued a worldwide alert announcing expanded online presence reviews for all H-1B and H-4 visa applicants as part of routine visa vetting procedures. The measure, effective immediately, requires consular officers to examine applicants' social media activity, public online profiles, and digital footprints to assess eligibility and detect potential fraud or security risks. This builds on existing protocols initially piloted for certain categories, now applied universally to the popular specialty occupation visa program widely used by Indian IT professionals and their dependents.

The alert emphasizes that the enhanced screening aims to curb abuse of the H-1B program, including fraudulent applications and misuse by employers or individuals. Applicants may be asked to provide social media handles used in the past five years, with reviews focusing on content that could indicate ineligibility under immigration laws, such as extremist views, criminal activity, or inconsistencies with submitted information. The State Department clarified that protected speech alone will not lead to denials, but patterns suggesting fraud or threats could impact outcomes.

This development comes amid ongoing scrutiny of the H-1B system, which faces annual caps and high demand, particularly from Indian nationals who dominate approvals. For fiscal year 2025, over 400,000 petitions were filed despite a lottery limiting selections. Critics argue such measures could prolong processing times and deter talent, while supporters view them as necessary safeguards against program vulnerabilities exposed in recent audits.

H-4 visa holders, typically spouses and children of H-1B workers, are also subject to the reviews, potentially affecting family reunification. Applicants are advised to review their online presence carefully and ensure consistency across platforms. As the change takes effect globally, it may influence upcoming visa interviews and renewals, underscoring evolving security priorities in US immigration processes.
