The Supreme Court on Friday sought a response from HDFC Bank Managing Director and CEO Sashidhar Jagdishan in connection with a plea filed by the Lilavati Kirtilal Mehta Medical Trust challenging a Bombay High Court order that had quashed an FIR registered against him over alleged illegal payments from trust funds.
A bench comprising Justices M M Sundresh and N Kotiswar Singh issued notice on the petition filed by the Lilavati Trust and its permanent trustee Prashant Kishore Mehta, which is contesting the Bombay High Court’s May 5 ruling. The apex court directed Jagdishan to file his response in the matter during the next hearing.
The case stems from allegations that Jagdishan allegedly colluded with former trustees of the charitable hospital trust and received approximately ₹2.05 crore in purported illegal payments between March 16, 2022, and June 21, 2023. The trust has argued that the High Court erred in quashing the FIR and overstepped its jurisdiction by treating the matter as a private dispute arising from internal disputes and recovery proceedings.

Appearing for the trust, senior advocate Sidharth Luthra, along with advocate Gaurav Goel, submitted that the High Court failed to adequately consider the seriousness of the alleged economic offences involving diversion and siphoning of funds from a major charitable institution. The petition further contends that the order prematurely halted an ongoing investigation at a preliminary stage despite what it describes as substantial incriminating material already collected.
The trust also argued that parallel proceedings and additional FIRs relating to broader allegations of financial irregularities and conspiracy are still pending investigation. It maintained that the quashing of the FIR prevented custodial interrogation and deeper scrutiny of documentary evidence linked to the alleged transactions.
While the Supreme Court has agreed to examine the matter by issuing notice, it also indicated that it was not inclined to interfere with the High Court’s decision at this stage. The case will now proceed with responses from the concerned parties, including Jagdishan, before further consideration by the apex court.
