NIA Court Issues Non-Bailable Warrant Against Hizbul Chief Syed Salahuddin

NIA court in Budgam issues non-bailable warrant against Hizbul Mujahideen chief Syed Salahuddin in terrorism case.

The NIA Special Court in Budgam, Jammu and Kashmir, on Saturday issued a non-bailable warrant against Mohammad Yusuf Shah, widely known as Syed Salahuddin, the supreme commander of the Hizbul Mujahideen. The order comes in connection with FIR No. 331/2012 under Sections 13, 18, 20, 39 of the Unlawful Activities (Prevention) Act (UAP Act) and Section 506 of the Indian Penal Code.

Assistant Public Prosecutor Mohammad Iqbal Rather told the court that Salahuddin is implicated in multiple crimes under the UAP Act but has crossed over into Pakistan and is currently evading arrest. Certificates from the SHO of Budgam and In-charge of Soibugh police post confirmed his absence and illegal border infiltration.

The court noted that the Investigating Officer has collected sufficient prima facie evidence linking Salahuddin to the alleged crimes. The offences under the UAP Act include acts of terrorism, unlawful activities, and criminal intimidation, emphasizing the severity of the charges against him.

The order also stated that the original case diary has been sent to the competent authority for sanction to produce the chargesheet, allowing trial in absentia. This step is part of the formal procedure to ensure judicial proceedings can continue despite the accused being outside India.

Observing that Salahuddin is actively evading arrest, the NIA court directed Jammu and Kashmir police to take immediate steps to apprehend him. The non-bailable warrant ensures that he cannot obtain bail if apprehended, reflecting the seriousness of the charges.

This development marks a significant step in India’s ongoing legal and counter-terrorism measures against Hizbul Mujahideen leadership. Authorities continue to monitor cross-border activities and coordinate with relevant agencies to bring the accused to justice.
