Harvard Advises International Students to Return Before New US Visa Rules Take Effect

Harvard University has advised international students and scholars to carefully review their travel plans and consider returning to the United States before September 15, when proposed changes to visa rules for F-1 and J-1 holders are expected to take effect. The changes by the US Department of Homeland Security could alter how international students and exchange visitors are permitted to remain in the country. Harvard's guidance comes as students prepare for the new academic year and assess the potential immigration implications of international travel.

The proposed rules would replace the current “duration of status” system, under which eligible F-1 and J-1 visa holders can generally remain in the US while continuing to meet the requirements of their academic or exchange programmes. Under the new framework, many students could instead receive a specific end date for their authorised stay. The date could be recorded through an “Admit Until Date” on their Form I-94, indicating how long they are permitted to remain in the country.

The timing of international travel could become particularly important under the proposed system. Students who are already in the US and maintaining valid immigration status when the rules take effect may be covered by transition provisions. However, students who leave the country and seek to return on or after September 15 could potentially be admitted under the new fixed-date system, subject to the immigration rules and documentation applicable at that time.

The changes could also affect students who need additional time to complete their academic programmes. Instead of continuing under the existing duration-of-status arrangement, eligible students may have to seek a formal extension of their authorised stay. For international students, including those from India, the proposed changes mean that travel plans around the September 15 deadline may require additional consideration. Students planning to travel outside the US have been advised to review their visa documents, Form I-20 or DS-2019 and I-94 records before making arrangements. Those expecting to require additional time for their degree programmes, Optional Practical Training or STEM OPT should also pay close attention to any new extension requirements.

The proposed policy is facing legal challenges from organisations representing higher education and labour interests, creating uncertainty over how and when the changes could ultimately be implemented. Until there is further action by the courts or the US government, international students are being encouraged to monitor official updates and consult their university's international office before travelling. Harvard's guidance highlights the importance of understanding the potential immigration consequences before making international travel plans close to the September 15 deadline.
