Delhi HC: Pilot Fatigue Rule Lapses Threaten Public Safety – DGCA Must Enforce Norms

The Delhi High Court on Wednesday expressed serious concerns over public safety, stating that the non-implementation of pilot fatigue regulations by the Directorate General of Civil Aviation (DGCA) cannot be brushed aside. The remarks came while hearing a public interest litigation (PIL) challenging the regulator’s recent relaxation of mandatory fatigue-management rules for pilots.

The case arose after IndiGo cancelled hundreds of flights in early December 2025, citing inadequate preparedness to implement the new Flight Duty Time Limitations (FDTL). On December 5, 2025, the DGCA granted exemptions to ease operational disruptions, allowing airlines to substitute leave with weekly rest periods, a move criticized for compromising safety.

While the airline argued that the matter of pilot fatigue was already under review in a separate petition, the court noted that public safety concerns extend beyond individual petitions. “Once in force, the regulations must be implemented unless revised by competent authorities,” the bench observed, highlighting the direct link between fatigue rules and passenger safety.

The PIL petitioner, a former aircraft engineer, alleged that the DGCA’s relaxation of rules was applied selectively and mala fide, benefiting IndiGo. The court, however, clarified that the notification applied to all airlines, but stressed that uniform enforcement of fatigue norms is mandatory to prevent unsafe rostering and ensure adequate staffing.

The Delhi High Court directed the DGCA to assess airline preparedness, enforce compliance, and suspend non-compliant schedules as required under International Civil Aviation Organisation (ICAO) guidelines. The matter is listed for further hearing on Thursday, with the DGCA asked to submit instructions on implementing the rules.

Experts and aviation safety advocates warn that lax enforcement of fatigue regulations can increase the risk of pilot error, accidents, and operational hazards, urging regulators to maintain strict oversight to safeguard passenger safety across India’s commercial airlines.
