Bihar Police Oppose Khan Sir's Plea to Quash FIR in Firing Case

The Bihar Police has opposed educator and YouTuber Faisal Khan, popularly known as Khan Sir, in his plea before the Patna High Court seeking the quashing of an FIR registered against him in connection with an alleged firing incident outside his coaching institute. In its submission, the police argued that merely possessing a valid arms licence does not grant an unrestricted or absolute right to use firearms in a public place. The case is currently under judicial consideration, with the High Court examining Khan's petition.

The development follows a Patna court's decision to grant anticipatory bail to Khan and three of his staff members in the case. Additionally, two security guards who had been arrested in connection with the incident were granted regular bail. While the bail orders provided temporary legal relief to the accused, the investigation into the alleged firing incident remains ongoing, and the FIR continues to be challenged before the High Court.

Khan approached the Patna High Court on June 9 through advocates Abhishek Kumar, Urvashi Bharti and Shubham Shivansh, seeking the quashing of the FIR. In his petition, he argued that no firearm or ammunition had been recovered from him and contended that the allegations did not justify the continuation of criminal proceedings. He also sought protection from coercive action, including arrest, along with other reliefs related to the functioning of his coaching institutes.

Opposing the petition, the Bihar Police maintained that the existence of a valid arms licence cannot be interpreted as permission to discharge firearms in public under any circumstances. The state argued that the legal framework governing firearms requires licensed weapon holders to comply with statutory restrictions and public safety norms. According to the police, these issues warrant a full investigation and should not be dismissed at the preliminary stage through the quashing of the FIR.

The alleged firing incident outside Khan's coaching institute had attracted considerable public attention, prompting police to register a criminal case and initiate an investigation. While the precise circumstances surrounding the incident remain under scrutiny, authorities have continued to collect evidence and examine statements as part of the probe. The matter has since evolved into a legal dispute over the validity of the FIR and the extent of criminal liability, if any.

The Patna High Court is expected to decide whether the FIR should be quashed or whether the investigation should continue in accordance with the law. Until then, the interim relief granted through anticipatory bail remains separate from the merits of the case. The outcome of the proceedings is likely to determine the future course of the investigation and the legal position of the accused in the matter.
