West Bengal Assembly Sends Disqualification Notices to 10 Rebel TMC MLAs

The West Bengal Assembly Secretariat has issued notices to 10 rebel Trinamool Congress MLAs in connection with a petition seeking their disqualification from the state legislature. The notices were sent to Leader of Opposition Ritabrata Banerjee and nine other legislators, bringing the issue into a formal stage under the Assembly’s prescribed procedure. The development comes amid an ongoing dispute over the legislators’ political conduct and their alleged departure from the party’s official position.

The notices require the lawmakers to respond to the disqualification plea and explain their position before further proceedings are taken up. The issuance of notices is part of the process through which the Assembly examines allegations made against members. It does not, by itself, mean that the legislators have already been disqualified or that a final decision has been reached in the matter.

The petition reportedly concerns the MLAs’ alleged activities as rebel members of the Trinamool Congress and questions surrounding their conduct in relation to the party and the state legislature. The proceedings may examine whether the allegations attract provisions under the constitutional anti-defection framework or other applicable Assembly rules. The precise grounds and arguments will be considered during the response and hearing stages.

Ritabrata Banerjee, who is currently the Leader of Opposition, is among the 10 legislators who received the notice. The remaining nine MLAs will also have an opportunity to submit their explanations within the time period specified by the Secretariat. Their responses are expected to form part of the official record before the competent authority examines the petition and determines the next course of action.

Disqualification petitions involving elected representatives can involve questions of party affiliation, legislative conduct, recognition of political groups and compliance with constitutional provisions. Such matters generally require examination of documents, statements and the circumstances under which the alleged violations took place. The Assembly authority will have to consider the submissions from both sides before issuing any final order.

The notices are expected to add to the political tensions surrounding the rebel TMC legislators and their role in the West Bengal Assembly. However, no final disqualification has been announced at this stage. The 10 MLAs remain members of the legislature unless and until a competent authority passes an order following the completion of the prescribed proceedings.
