Mehul Choksi’s Extradition Appeal to be Heard by Belgium’s Supreme Court on December 9

Belgium’s Supreme Court will review Mehul Choksi’s appeal against extradition to India on December 9.

Belgium’s Court of Cassation has scheduled December 9, 2025, to hear the final appeal of fugitive businessman Mehul Choksi against his extradition to India in connection with the ₹13,000-crore Punjab National Bank loan fraud case. The supreme court, which reviews decisions only on points of law and procedure rather than fresh evidence, represents Choksi’s last judicial recourse after the Antwerp Court of Appeal rejected his challenge on October 17.

The Antwerp appellate bench upheld an earlier ruling that two arrest warrants issued by a special Mumbai court in 2018 and 2021 are enforceable in Belgium. It concluded that Choksi, accused of personally syphoning ₹6,400 crore, failed to provide “concretely plausible” evidence of a genuine risk of torture, inhuman treatment, or denial of justice if returned to India. The court accepted diplomatic assurances from New Delhi covering prison conditions, medical care, and fair-trial guarantees.

Choksi fled India in January 2018, days before the fraud was uncovered, and subsequently obtained citizenship of Antigua and Barbuda. He was located and detained in Belgium in 2024 while reportedly seeking medical treatment, prompting India to lodge a formal extradition request in August of that year.

Recent media speculation that Choksi had fled to Cuba has been firmly denied both by his Belgian legal team and by Antiguan Prime Minister Gaston Browne, who described such reports as highly improbable.

The Court of Cassation hearing will be conducted primarily through written submissions, with oral arguments limited to elaborating on previously filed legal complaints. A decision is expected shortly after December 9.

If the appeal is dismissed, Belgium will be free to execute the extradition order, potentially closing a seven-year international manhunt for one of the main accused in India’s largest-ever banking scam.
