Delhi High Court Dismisses Sanjay Bhandari’s Petition Challenging Fugitive Offender Label

Delhi HC dismisses Bhandari’s plea challenging fugitive offender status.

The Delhi High Court has dismissed a plea filed by Sanjay Bhandari challenging his designation as a fugitive economic offender, dealing a setback to the businessman in an ongoing legal battle over financial misconduct allegations.

Bhandari had approached the court contesting a trial court’s decision that declared him a “fugitive economic offender” under the Fugitive Economic Offenders Act, arguing that the proceedings were flawed and that he had not deliberately evaded Indian authorities. However, the High Court rejected his arguments, upholding the earlier ruling and allowing enforcement actions against him to continue.

The case against Bhandari is being pursued by the Enforcement Directorate, which has accused him of financial irregularities, including violations linked to foreign exchange regulations and undisclosed overseas assets. Investigators have alleged that Bhandari fled India to avoid prosecution and has since remained abroad, prompting authorities to initiate proceedings under the Fugitive Economic Offenders Act.

Being declared a fugitive economic offender allows agencies to confiscate properties and assets linked to the individual, both in India and abroad, without waiting for the conclusion of criminal trials. The law was enacted to deter economic offenders from evading legal proceedings by remaining outside the country.

Bhandari, who is currently believed to be in the United Kingdom, has been contesting multiple legal actions initiated against him in India. His legal team had argued that the designation was unjustified and sought relief from the High Court, but the dismissal of his plea reinforces the validity of the enforcement proceedings.

The ruling is significant in the broader context of India’s efforts to crack down on economic offenders who leave the country to avoid investigation. With the High Court’s decision, authorities are expected to continue their pursuit of Bhandari’s assets and legal accountability under the existing framework.
