Allahabad HC Directs UP Government to Submit Arms Policy and District-Wise Firearm Data

Allahabad HC flagged licensed gun misuse and sought statewide firearms data from UP.

The Allahabad High Court has expressed concern over what it termed the growing “gun culture” in the state and sought detailed data on licensed firearms from the government. The court has directed authorities to provide a comprehensive report on firearm licences and clarify whether a formal arms policy exists to regulate their use and display.

A bench led by Justice Vinod Diwakar made the observations while hearing a writ petition, highlighting the increasing public display of weapons, both physically and on social media platforms. The court has asked the Additional Chief Secretary (Home) to submit an affidavit addressing key concerns, including regulatory measures and policy frameworks.

The court has also directed district magistrates and police chiefs across all 75 districts of Uttar Pradesh to furnish details of individuals holding licensed firearms. This includes information on their criminal history or any pending cases, indicating a deeper scrutiny of how such licences are granted and monitored.

In its observations, the bench noted that in several rural and semi-urban areas, firearm ownership is often perceived as a symbol of power, masculinity, and social influence. It added that individuals with political ambitions or questionable backgrounds sometimes use licensed weapons to project dominance and authority, contributing to an atmosphere of fear among the public.

The court further flagged the role of social media in amplifying this trend, noting that the display of firearms in reels and posts is increasingly being used to gain attention and social validation. Such portrayals, the bench suggested, may reinforce a culture that normalises weapon display and intimidation.

The directions from the High Court come amid broader concerns about public safety and responsible firearm usage. The outcome of the affidavit and the state’s response could play a key role in shaping stricter regulations and policies aimed at curbing misuse and ensuring that licensed weapons do not contribute to fear or lawlessness.
