Sunjay Kapur's Children Demand Criminal Action Against Priya Over Forged Will Allegations

Siblings allege Priya fabricated a will excluding them, cite timeline mismatches and a fake digital trail, and seek phone seizures.

The Sunjay Kapur Will dispute has intensified, with his children, Samaira and Kiaan Kapur, seeking criminal action against Priya Kapur, the industrialist’s second wife, alleging forgery and manipulation of the digital trail related to the will.According to sources, the siblings have requested the Delhi High Court to invoke Sections 338 and 340 of the Bharatiya Nyaya Samhita against Priya Kapur, claiming that the will presented in court excludes them from their rightful inheritance. If convicted, Priya could face life imprisonment.

Samaira and Kiaan argued that their father and Priya were not in Gurgaon on March 21, 2025—the date the will was allegedly executed—but in Delhi. They claimed communication with Karisma Kapoor via WhatsApp during that period regarding Portuguese citizenship matters, contradicting Priya’s assertion that Sunjay executed the will in Gurgaon in the presence of attesting witnesses Dinesh Aggarwal and Nitin Sharma.

The siblings have also highlighted inconsistencies in the digital trail. They allege the earliest records originate from Sharma’s device, later transposed to Aggarwal and finally shared in a WhatsApp office group on March 24, 2025—three days after the will’s purported execution. Furthermore, there is no trace of Sunjay Kapur’s input on the digital record, raising questions about its authenticity.

The role of Shraddha Suri Marwah, the executor, has also been questioned. Sources say she received a copy of the will only in late June 2025, despite claiming to be a close friend of Sunjay Kapur. Additionally, the will contains multiple spelling and grammatical errors inconsistent with Sunjay Kapur’s education and writing style, including misnaming “Master Azarias” as “Master Azrias” and referring to the male testator as “her.”

The children have requested the seizure of mobile devices belonging to Priya Kapur, Sunjay Kapur, and the witnesses to further investigate the alleged forgery. This development could escalate the case from a civil partition suit into a criminal investigation, adding a new dimension to the ongoing family dispute.
