CBI Joint Director, Retired Officer Get 3-Month Jail in IRS Case

Delhi court jails CBI officers for 2000 IRS raid assault.

A Delhi court has sentenced two officers of the Central Bureau of Investigation (CBI) to three months’ simple imprisonment in a case involving the assault of an Indian Revenue Service officer during a raid conducted over two decades ago.

The court found that the officers had trespassed into the residence of the Indian Revenue Service (IRS) officer and physically assaulted him during the operation in 2000. Delivering the verdict, the court observed that the accused had acted in “sheer violation of their legal powers as public servants.”

The convicted individuals include a serving senior CBI official, currently holding the position of joint director, and a retired police officer who was part of the team at the time. The case dates back to an incident involving the arrest and alleged mistreatment of IRS officer Ashok Kumar Aggarwal, who later pursued legal action against those involved.

Judicial Magistrate Shashank Nandan Bhatt, who presided over the case, had earlier convicted the two officers on charges including criminal trespass, assault, and misconduct during the discharge of official duties. The sentencing followed arguments on the quantum of punishment after their conviction earlier this month.

The ruling underscores the judiciary’s stance on accountability within law enforcement agencies, particularly in cases involving abuse of authority. Courts have repeatedly emphasized that officials entrusted with investigative powers must adhere strictly to legal boundaries while carrying out their duties.

The case also highlights the prolonged nature of legal proceedings in India, with the incident dating back more than two decades before culminating in a conviction and sentencing. Legal experts note that while delayed, such judgments reinforce the principle that misuse of power by public servants will ultimately face judicial scrutiny.
