Supreme Court fines Samay Raina ₹3 lakh over conduct

The Supreme Court on Tuesday imposed a fine of ₹3 lakh each on stand-up comedian and YouTuber Samay Raina and four others for allegedly violating its earlier directions in a case concerning remarks about persons with disabilities. The court observed that Raina had failed to comply with one of its previous orders, prompting the bench to impose costs and issue a strong rebuke. A bench comprising Chief Justice of India Surya Kant and Justices Joymalya Bagchi and V. Mohan passed the order after it was informed that Raina had not invited persons with disabilities to his show, despite an earlier direction from the court. The judges expressed displeasure over what they viewed as non-compliance with their instructions.

According to the court, Raina had not adhered to its earlier directions, and the bench questioned the filing of an affidavit claiming compliance when, according to the court, no supporting material had been placed on record. “We have reason to believe that Samay Raina has taken the court for a ride and has brazenly violated the orders of this court. The misconduct is further compounded stating that an affidavit is filed when nothing is on record. Thus, we impose a cost of ₹3 lakh to be deposited within 2 weeks,” the bench said, according to a Bar and Bench report.

The matter stems from a petition filed by the Cure SMA India Foundation, which accused Raina of making insensitive remarks about the high cost of treatment for Spinal Muscular Atrophy (SMA) during one of his shows. The petition also alleged that he ridiculed a person living with the condition, raising concerns over the portrayal of persons with disabilities in online content. The foundation approached the Supreme Court seeking guidelines to regulate online broadcasts that it argued violated the right to life, dignity and equality of persons with disabilities. The petition urged the court to frame safeguards against content that could be considered discriminatory or derogatory towards disabled individuals.

During earlier proceedings, the Supreme Court had directed Raina to invite persons with disabilities to his show as part of its effort to encourage greater awareness and inclusion. However, the latest hearing was informed that the direction had not been complied with, leading the bench to conclude that its order had been disregarded. The court also criticised what it described as the filing of an affidavit asserting compliance without any material to substantiate the claim. The judges said such conduct amounted to a serious violation of the court's directions and warranted the imposition of costs.

The fine of ₹3 lakh each must be deposited within two weeks, the bench ordered. The ruling underscores the judiciary's emphasis on ensuring respect for the dignity of persons with disabilities and compliance with court directions in matters involving public figures and digital content. The case continues to draw attention to the responsibilities of content creators and comedians in ensuring that their material does not demean or stigmatise vulnerable communities. It also highlights the broader legal debate over balancing freedom of expression with the rights and dignity of persons with disabilities in the rapidly expanding digital entertainment landscape.
